Terms and Conditions

1. About Us
Wiltshire Scuba Training & Servicing Ltd (“Wiltshire Scuba”, “we”, “us” or “our”) is a company registered in England and Wales, company number 16835860, whose registered office is at Unit 36, BSS House, Cheney Manor Ind. Estate, Swindon, Wiltshire, SN2 2PJ. We provide scuba training, PADI courses, IDEST-related courses and services, cylinder testing, servicing, air fills, equipment sales and related services.
These Terms and Conditions apply to all bookings, purchases, invoices and payments made with us, whether online, by email, by telephone, in person, by payment link or by invoice.
By booking with us, purchasing from us, or paying any invoice or payment link issued by us, you confirm that you have read and agreed to these Terms and Conditions.
Nothing in these Terms and Conditions affects your statutory rights.
2. Definitions
For the purposes of these Terms and Conditions:
Course means any scuba, first aid, IDEST or related training course provided by us.
Digital materials means any eLearning, online code, digital manual, digital training material, certification fee or other digital content.
Bespoke booking means any private, 1:1, custom, one-day, special-date, extra pool session, additional pool time or other booking arranged specifically to meet a customer’s individual request.
Goods means any retail products, equipment or physical items sold by us.
Services means cylinder testing, servicing, inspections, air fills, oxygen cleaning, regulator servicing, IDEST-related services, repairs and similar work.
Dive Club or Membership means Wiltshire Scuba’s Dive Club membership, whether paid for or provided complimentary, as described in section 18.
Initial Term means the first 12 months of a paid Membership, beginning on the membership start date.
Membership Year means the 12-month period beginning on the applicable membership start date.
Rewards means the Wiltshire Scuba Rewards customer loyalty programme described in section 19.
Gift Card means a Wiltshire Scuba gift card or voucher carrying stored value, issued electronically or as a physical card, and administered through our gift-card system, currently Gift Up.
3. Booking and Contract Formation
A contract is formed when we accept your booking, confirm your order, issue your course place, issue digital materials, confirm a service booking, dispatch goods or accept payment, whichever happens first.
We reserve the right to refuse a booking, order or service request where necessary, including where medical, safety, scheduling, stock or legal issues arise.
Where a booking is made by invoice, payment link, telephone or email, the customer is responsible for reviewing these Terms and Conditions before payment.
4. Prices and Payment
All prices are shown in pounds sterling unless otherwise stated.
Payment may be required in full at the time of booking unless we agree otherwise in writing.
We reserve the right not to:
- release digital materials
- reserve dates
- book pool time
- book venues
- allocate instructors
- order products
- start work
- provide services
until payment has been received in cleared funds.
If any invoice is not paid by the due date, we may suspend or cancel the booking, order or service.
5. Medical Fitness and Safety
Scuba diving and related activities require an appropriate level of health, fitness and competence.
It is your responsibility to:
- complete all medical declarations honestly and fully
- tell us about any relevant medical condition
- obtain any medical approval required before taking part
If you answer “yes” to any medical question, or if medical clearance is required, you must obtain approval from an appropriate doctor before taking part. In some cases, a GP sign-off may not be sufficient and specialist diving medical advice may be required.
If you are unable to participate because you do not meet the medical requirements for diving or related activities, this will normally be treated as a customer cancellation unless we have cancelled the booking ourselves.
Where possible, we may offer a transfer to a later date, but this is at our discretion and subject to availability.
Any refund in these circumstances will be subject to deduction of:
- any non-refundable digital materials purchased from Wiltshire Scuba and already ordered, issued, redeemed, activated, accessed or sent to you
- any costs already committed specifically for your booking, including pool hire, venue hire, instructor allocation, third-party fees and bespoke booking costs
If you purchased eLearning or other digital materials directly from PADI or another third party, any refund or credit for that element must be requested directly from that third party.
We reserve the right to refuse, postpone or stop training or participation at any time if we reasonably believe it would be unsafe or inappropriate for you to continue.
6. Recreational Course Bookings
This section applies to PADI and other recreational scuba courses, including but not limited to:
- Discover Scuba Diving
- Open Water Diver
- Advanced Open Water Diver
- Rescue Diver
- Reactivate
- children’s programmes
- speciality courses
- refresher sessions
- similar leisure training
Course dates, venues, instructors and pool sessions are planned in advance and spaces are limited.
Cancellation charges reflect the real costs and losses that arise when places, instructors, venues or pool sessions cannot be refilled at short notice.
If you cancel a standard scheduled course:
More than 21 days before the course start date
We will refund sums paid less any non-refundable digital materials purchased from Wiltshire Scuba and any non-recoverable costs already committed specifically for your booking.
Between 8 and 21 days before the course start date
We may retain up to 50% of the course price, together with any non-refundable digital materials purchased from Wiltshire Scuba and any non-recoverable costs already committed specifically for your booking.
7 days or less before the course start date
We may retain up to 100% of the course price where costs have been incurred or the place cannot reasonably be refilled, together with any non-refundable digital materials purchased from Wiltshire Scuba and any non-recoverable costs already committed specifically for your booking.
Where our actual loss is lower, we may reduce the amount retained.
Where our actual loss is higher because of specific commitments already made for your booking, we may retain those additional committed costs.
At our discretion, we may offer a transfer instead of a refund. Any transfer is subject to availability and may require payment of any difference in price or additional costs arising from the change.
7. Bespoke, Private and 1:1 Bookings
This section applies to all bespoke bookings, including:
- private tuition
- 1:1 courses
- one-day custom courses
- additional pool time
- exclusive sessions
- custom dates
- special instructor allocation
- similar arrangements made specifically at your request
Because bespoke bookings involve costs being committed specifically for one customer, those costs are often non-recoverable if cancelled.
For bespoke bookings:
- Any deposit, bespoke supplement or separately quoted custom charge may be non-refundable once the booking has been confirmed.
- Any pool hire, venue hire, instructor time, travel costs, third-party fees, digital materials purchased from Wiltshire Scuba or other costs committed specifically for the bespoke booking are non-refundable once booked or incurred.
- If you cancel, any refund will be limited to sums paid over and above those committed and non-recoverable costs.
- If we are able to refill the slot or recover the costs, we may offer a partial refund or transfer at our discretion.
8. Digital Materials and eLearning
Digital materials include:
- PADI eLearning
- online training codes
- digital manuals
- digital training packs
- digital certification fees
- similar digital products
Where digital materials are purchased from or supplied by Wiltshire Scuba, whether separately or as part of a course package, they are non-refundable once they have been ordered, issued, redeemed, activated, accessed or sent to you.
Where digital materials are supplied immediately, you expressly agree that supply may begin straight away and that any cancellation rights applying to that digital content element are lost once supply has begun.
If a booking includes both digital materials and practical training, the digital materials element and the practical training element may be treated separately for refund purposes.
If you purchased eLearning or other digital materials directly from PADI or another third party, and not from Wiltshire Scuba, any refund, credit or transfer request for that element must be taken up directly with that third party in accordance with their terms and conditions.
Wiltshire Scuba is not responsible for refunding digital materials purchased directly by a customer from PADI or any other third party.
9. Transfers and Rearranging Courses
If you ask to transfer to another date, we will try to accommodate this where possible, but we are not obliged to do so.
Any transfer request must be made in writing.
If we agree to a transfer:
- digital materials already issued by Wiltshire Scuba remain non-refundable
- any committed pool, venue, instructor or bespoke costs may still be payable
- any increase in price or additional cost must be paid by you
- repeated transfers may be refused
If you fail to attend, arrive too late to participate, fail to complete required eLearning in time, fail to obtain medical approval in time, or cannot take part because required forms or prerequisites are missing, this will usually be treated as a late cancellation.
10. Cancellations by Wiltshire Scuba
We reserve the right to alter course dates, venues, instructors or schedules where reasonably necessary, including because of:
- weather
- safety concerns
- staff illness
- insufficient student numbers
- pool or venue availability
- equipment issues
- circumstances outside our reasonable control
Where we cancel a course entirely and cannot offer a suitable alternative, we will refund the amount paid to us for the cancelled element, less any digital materials already purchased from Wiltshire Scuba and already issued which remain valid and non-refundable.
We are not responsible for any indirect or consequential losses, including:
- travel
- accommodation
- time off work
- similar costs booked by you
11. Retail Goods
This section applies to physical goods purchased from us.
If you buy goods online, by phone, by email or otherwise at a distance as a consumer, you may have a legal right to cancel within 14 days after delivery, subject to the exceptions set out below.
To exercise any cancellation right, you must notify us in writing within the required period and return the goods to us promptly and in suitable condition.
You are responsible for return postage costs unless the goods are faulty, damaged, not as described, or we agree otherwise.
We may reduce any refund to reflect any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
The following are non-returnable or may not be cancelled for change of mind unless faulty:
- bespoke, personalised or special-order goods
- sealed items where the seal has been broken and which are not suitable for return for hygiene or safety reasons
- goods damaged after delivery by misuse, neglect, improper storage or fair wear and tear
Nothing in this section affects your statutory rights in relation to faulty, misdescribed or unfit-for-purpose goods.
12. Special-Order, Bespoke or Measurement-Based Retail Items
Certain retail items, including made-to-measure, special-order, custom-configured or personalised products, are ordered specifically for you.
Once such items have been ordered from our supplier, they cannot be cancelled or returned for change of mind unless faulty.
Any deposit or payment made for these goods may be non-refundable once the order has been placed.
13. Servicing, Cylinder Testing, Air Fills and Workshop Services
This section applies to:
- regulator servicing
- cylinder inspections
- hydrostatic tests
- oxygen cleaning
- valve servicing
- shot blasting
- air fills
- Nitrox fills where applicable
- repairs
- similar services
Estimated turnaround times are approximate only.
If you book a service and then cancel before we begin work, we may charge for:
- any parts ordered
- third-party fees
- testing fees
- inspection fees
- transport costs
- labour already carried out
- any other committed costs
Once work has started, you will be liable for the cost of labour, parts, third-party charges and any other work carried out or costs incurred up to the point of cancellation.
If a cylinder, regulator or other equipment fails inspection or testing, you remain responsible for the cost of the inspection, testing, labour and any work already carried out.
We reserve the right to refuse to fill, test, service or return for use any equipment which we consider unsafe, unserviceable, out of test, unsuitable or non-compliant.
14. IDEST Courses and Other Professional or Technical Courses
This section applies to IDEST courses and any other technical, servicing or professional training courses provided by us.
If you cancel:
More than 21 days before the course start date
We will refund sums paid less any digital materials purchased from Wiltshire Scuba and already issued, and any costs already committed specifically for your booking.
Between 8 and 21 days before the course start date
We may retain up to 50% of the course fee together with any committed and non-recoverable costs.
7 days or less before the course start date
We may retain up to 100% of the course fee where the place cannot reasonably be refilled or costs have already been incurred.
At our discretion, we may offer a transfer instead of a refund.
15. Invoices, Payment Links and Direct Bookings
Where we issue an invoice or payment link for a course, goods or services, payment of that invoice or link confirms acceptance of these Terms and Conditions.
Where the invoice or payment link relates to:
- a course booking, the course cancellation provisions above apply
- bespoke or private training, the bespoke booking provisions above apply
- goods, the retail provisions above apply
- servicing or testing, the service provisions above apply
If an invoice includes both refundable and non-refundable elements, we may allocate any refund accordingly.
16. Non-Attendance and Failure to Complete
No refund will be due if you:
- fail to attend
- arrive late and cannot participate
- do not complete required pre-course work in time
- fail to provide required paperwork or identification
- fail to obtain medical clearance in time
- are refused participation on safety grounds because of information you did not disclose in advance
At our discretion, we may allow rebooking or transfer, subject to payment of any additional costs.
17. Customer Responsibility
You are responsible for ensuring that:
- all information you provide is accurate and complete
- you meet all prerequisites for the booking
- you hold any required medical approval before taking part
- your equipment is suitable, in date and safe where you are using your own equipment
- you comply with instructions from instructors, staff and facility operators
We are not responsible for losses caused by incorrect information provided by you, failure to disclose relevant details, or failure to follow reasonable instructions.
18. Wiltshire Scuba Dive Club Membership
This section applies to Wiltshire Scuba Dive Club membership. The other sections of these Terms and Conditions continue to apply to anything a member books, buys, or has tested or serviced.
Price, initial term and what happens next
Membership begins with an Initial Term of 12 months. It is available as:
- Monthly — £15 per month. The Initial Term is 12 months, so the committed cost is £180. After the Initial Term, membership continues as a rolling monthly membership at the then-current monthly price until you cancel it.
- Annual — £150 for the Initial Term of 12 months. After the Initial Term, membership renews automatically for a further 12 months at the then-current annual price, unless you tell us beforehand that you do not want it to.
The monthly option is not a cancel-any-time subscription during the Initial Term. It is a 12-month membership with the cost spread over the year.
Both options renew automatically. We tell you this clearly before you pay, not only here. The current prices are shown on the Dive Club page and again at checkout.
When membership starts
Membership starts when we confirm it following successful payment, or, for complimentary membership, on the date set out below. Your Membership Year, and any benefit allowance measured by Membership Year, runs from that date.
Your right to cancel within 14 days
Where you buy membership online, by telephone or otherwise at a distance as a consumer, you have a legal right to cancel within 14 days of the day your membership is confirmed, without giving a reason.
Membership benefits are available to you straight away. When you complete checkout you expressly ask us to begin providing membership immediately, and you accept that if you then cancel within the 14-day period you must pay a proportionate amount for the period of membership already provided.
That proportionate amount is calculated by reference to time: the total price for the Initial Term, divided across the days of that term, multiplied by the number of days from the start of membership to the day you told us. We do not make any separate deduction for individual benefits you have used during that period.
To cancel, tell us in writing, or use the cancel option in your account. We will refund within 14 days of being told, using the same payment method you used.
Turning off automatic renewal
You can turn off automatic renewal at any time, including during the Initial Term, using the cancel or renewal option in your account or by telling us in writing. Turning it off does not end your current membership — you keep every benefit until the end of the period you have paid for, and it simply does not renew after that.
We will send you a reminder before your membership renews, so you can turn renewal off before any payment is taken. We will send it at least 30 days before an annual renewal, and at least 14 days before a monthly renewal. We keep a record of the reminders we send and of the consents you give at checkout.
Cancelling after the Initial Term
Once the Initial Term has ended, monthly membership is rolling and you can cancel it at any time. Cancellation takes effect at the end of the monthly period you have paid for, and you keep your benefits until then.
Where annual membership has renewed, you may cancel within 14 days of the renewal and we will refund the renewal payment less a proportionate amount, calculated by time, for the days of the renewed membership already provided.
You are also free to cancel a renewed annual membership at any point during the renewed year, not only in the first 14 days. If you do, we will refund the unused whole months. A renewed year does not lock you in: the 12-month commitment applies to the Initial Term only.
Ending membership during the Initial Term
During the Initial Term, membership runs for the full 12 months and any remaining monthly instalments remain payable.
We will however release you from the rest of the Initial Term, and stop any further instalments, where your circumstances change materially so that you can no longer reasonably use your membership — for example if you move away from the area, lose your job, or injury or a medical condition prevents you from diving. We may ask for reasonable evidence. Where you paid annually, we will refund the unused whole months.
Price changes
We will not change the price of a membership during a period you have already paid for. Where the price will change at renewal, we will tell you in the renewal reminder, before any payment is taken, so you can decide whether to let it renew.
Failed payments
If a payment fails, we or our payment provider will try again. If it remains unpaid we may suspend Club benefits until it is paid; suspension does not extend the Membership Year. If it remains unpaid we may end the membership, and payments covering membership already provided remain due.
Included air fills
Membership includes 10 standard compressed-air fills per Membership Year. Once those have been used, members receive 10% off further qualifying standard air fills for the rest of that Membership Year.
- Nitrox, oxygen, trimix, gas blending and other specialist gases are not included unless we state otherwise.
- Normal cylinder suitability and testing requirements apply, and we may refuse to fill a cylinder we consider unsafe, unsuitable, out of test or non-compliant (see section 13).
- Included fills have no cash value.
- Unused included fills do not carry over into another Membership Year unless we state otherwise.
- Included fills are for the member’s own use and cannot be sold, shared or transferred.
Cylinder testing
Members receive 10% off cylinder visual inspections and hydrostatic tests. Unless we state otherwise, the discount does not apply to replacement components or third-party charges. The provisions in section 13 about failed cylinders and additional work continue to apply.
Servicing
Members receive 10% off qualifying servicing labour. Unless we state otherwise, the discount does not apply to service kits, replacement parts, consumables or third-party charges.
Where a service is sold at a single package price, we will tell you which part of that price is labour before the discount is applied.
Club pool sessions
Members may attend designated Wiltshire Scuba Club pool sessions without paying the usual pool session charge, using their own suitable equipment. This is subject to space and availability and applies to sessions we designate as Club or practice sessions. It is not access to every pool booking we run.
Members who need to use our equipment at a Club pool session can hire it at a discounted Club rate, which we will confirm when you book.
Equipment hire on Club dives
On designated Club dives and trips, standard recreational Wiltshire Scuba hire equipment is available to members at no additional hire charge, subject to availability and suitable sizing.
This applies only while taking part in the designated Club activity. It is not free independent or take-away equipment hire, and it does not automatically include specialist or technical equipment. Our normal provisions about the care of and responsibility for equipment continue to apply.
Guided Club dives
Guiding by Wiltshire Scuba on designated Club dives is included. Third-party costs are not. Unless we state otherwise for a particular event, you remain responsible for dive site admission, boat fees, accommodation, travel, parking, food and other third-party charges.
You must hold the certification and experience appropriate for the planned dive. We may change or cancel a dive plan where reasonably necessary because of conditions, safety or operational circumstances.
Priority booking
Members receive priority booking for selected Club dives, trips and activities. Priority does not guarantee a place where capacity is limited.
Complimentary membership for Open Water graduates
Customers who successfully complete a qualifying Wiltshire Scuba PADI Open Water Diver course receive 12 months of Dive Club membership included. Membership starts on successful completion of the course.
Complimentary membership:
- runs for 12 months and includes the normal Club benefits unless we state otherwise
- does not include the Club T-shirt, which is included with a first paid membership
- ends automatically at the end of those 12 months
- never becomes a paid membership automatically. We will not take any payment for membership at the end of a complimentary year. If you want to continue, you buy a membership in the normal way
- places you under no obligation to buy membership afterwards
Club T-shirt
A Wiltshire Scuba Dive Club T-shirt is included with your first paid membership. One shirt per member, subject to available sizes and stock, with no cash alternative. It is not included on renewal.
Membership is personal
Membership and its benefits are personal to the named member and cannot be transferred, sold or shared. This includes included air fills and member discounts.
Suspension and ending membership
We may suspend or end a membership where a member:
- behaves unsafely, or in a way that puts others at risk
- seriously or repeatedly breaches site, venue or Club rules
- abuses or threatens staff, customers or other members
- deliberately misuses membership benefits, or obtains them dishonestly
Where we end a membership for one of those reasons we will refund any amount you have paid for membership you will not now receive, less any loss we are entitled to recover.
If we end a membership for any other reason, we will refund the unused part of your membership in full and stop any remaining payments.
Changes to Club benefits
We may make minor or operational changes to Club benefits without notice — for example changing pool venues or session times, or changing how a benefit is administered.
If we make a change that materially reduces the value of a membership you have already paid for, we will tell you, and you may end your membership and receive a refund of the unused part.
19. Wiltshire Scuba Rewards
Rewards is our free customer loyalty programme. It is separate from Dive Club membership, and you do not need to be a member to take part.
Air fill rewards
Buy nine qualifying paid standard air fills and your next qualifying standard air fill is free.
Air fills provided free as part of Dive Club membership are not paid fills and do not count towards the nine.
Points
Qualifying purchases earn Rewards points, which can be redeemed as credit against future purchases. The current earning and redemption rates are published in our Rewards programme information and shown at the till. At the date of these Terms, the intended rates are one point for each £1 of qualifying spend, and £5 of reward credit for 500 points.
We may set and change reasonable programme rules, including which purchases qualify, which products or categories are excluded, the earning and redemption rates, and any promotional or bonus points. We will publish the rules that currently apply.
Rewards and discounts
Unless we state otherwise, discounted and free items do not earn Rewards points, and Rewards cannot be combined with Dive Club member discounts on the same item.
Points have no cash value
- Points and reward credit have no cash value and cannot be exchanged for cash.
- Points belong to the Rewards account that earned them and cannot be transferred or sold.
- Points earned on a purchase that is later refunded, cancelled or reversed will be removed.
- Points issued in error may be corrected.
If we introduce an expiry policy for points in future, we will give reasonable notice before it takes effect.
We may change or withdraw the Rewards programme by giving reasonable notice, and will give you a reasonable opportunity to redeem points you have already earned. We may suspend or close a Rewards account that is used dishonestly or fraudulently.
20. Gift Cards, Vouchers and Promotional Codes
Gift Cards
Wiltshire Scuba Gift Cards are administered through our gift card system, currently Gift Up. A Gift Card may be issued electronically, as a printable voucher, or as a physical card.
Gift Cards are issued in pounds sterling. No interest is paid on a Gift Card balance.
The electronic balance is the balance
A physical Gift Card is a means of accessing the electronic Gift Card record. The balance held in our gift card system is the authoritative balance.
Where a value is printed on a physical card, that printed value does not change when the card is partly used. The remaining electronic balance is what applies.
Using a Gift Card
- Gift Cards can be used towards Wiltshire Scuba courses, goods and services.
- A Gift Card can be used in part, and any remaining balance stays on the card for future use.
- If what you are buying costs more than the balance, the difference is paid by another accepted payment method.
- One Gift Card can be used on an online purchase. If you hold more than one, please contact us or call in and we will help.
- Gift Cards cannot be exchanged for cash, except where the law requires it.
Expiry
Gift Cards are valid for 12 months from the date of purchase. The expiry date is shown when the Gift Card is bought and on the Gift Card itself.
Cancelling a Gift Card you have bought — your legal rights
Where you buy a Gift Card online, by telephone or otherwise at a distance as a consumer, you have a legal right to cancel that purchase within 14 days of receiving the Gift Card, without giving a reason, and to receive a refund. Where a physical card was supplied, you must return it to us.
This is a statutory right and nothing in these Terms and Conditions removes or reduces it.
Our own Gift Card refund policy
Separately from your legal rights above, and in addition to them, it is our policy that:
- where a Gift Card has been partly redeemed, we will refund the unredeemed balance to the person who bought it, on request within the 14-day period
- where a Gift Card is unredeemed and still valid, we will consider a refund request from the purchaser after the 14-day period has passed
This policy is a goodwill arrangement rather than a legal right, and we may change it for future purchases. It does not affect your statutory rights, which are set out above.
Lost or stolen Gift Cards
Please tell us as soon as possible if a Gift Card or its code is lost or stolen. Anyone holding a valid code may be able to redeem it, so a code should be treated like cash.
Where we are reasonably satisfied who the Gift Card belongs to and it has not been redeemed, we can normally cancel the original code and issue a replacement for the remaining balance. We cannot replace value that has already been redeemed.
Using a Gift Card to pay for a course, goods or services
Paying with a Gift Card does not change the cancellation and refund terms that apply to what you have bought. For example, where a Gift Card is used towards an Open Water Diver course, the course cancellation provisions in section 6 still apply.
Where a refund is due to you as a matter of law — for example for faulty goods, or under a cancellation right — we will refund you in money, to the payment method used, and not in Gift Card credit. You may ask us to put it back on the Gift Card balance instead, but that is your choice, not ours.
Where a refund is not one we are legally required to give and we agree to one as a matter of goodwill, we will normally return the amount to the Gift Card balance.
Promotional and discount codes
Any voucher, discount code or promotional offer is subject to its own terms. Unless expressly stated otherwise, promotional and discount codes:
- are not redeemable for cash
- cannot be used after expiry
- may not be combined with other offers
- do not alter the cancellation terms that would otherwise apply
This does not affect Dive Club member discounts or Rewards, which are dealt with in sections 18 and 19.
21. Liability
Nothing in these Terms and Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud, or for any other liability which cannot legally be excluded.
Nothing in these Terms and Conditions excludes or restricts your statutory rights, including your rights in relation to goods under sections 9 to 17, 28 and 29 of the Consumer Rights Act 2015, and your rights in relation to services under sections 49 to 52 of that Act. Any term of these Terms and Conditions does not apply to the extent that it would do so.
Subject to the above, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or of our failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if you told us it might happen before the contract was made.
